Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Iteration Machine website, application, APIs, and related services (collectively, the “Service”) operated by Iteration Machine, Inc., a Delaware corporation (“Iteration Machine,” “we,” “us”). By creating an account or otherwise using the Service, you agree to be bound by these Terms.

1. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for the activity that occurs under your account, for keeping your credentials secure, and for the accuracy of the information you provide. We use Clerk to manage authentication; their terms also apply to your sign-in.

2. The Service

Iteration Machine is an automated growth agent. You connect third-party systems (such as GitHub, Google Analytics, Google Search Console, Google Workspace, Stripe, and PostHog) and we run experiments, generate code and content, and propose or apply changes to your product on your behalf. You retain control of which systems are connected and may disconnect them at any time.

3. Connected Accounts and Your Authority

When you connect a third-party account, you authorize Iteration Machine to access and act within that account on your behalf, subject to the scopes you grant. You represent that you are entitled to grant that authorization for the relevant project, repository, property, or workspace. You are responsible for ensuring that the actions the Service takes under your authorization comply with the terms of the underlying third-party provider.

4. Your Content

“Your Content” means data you submit to the Service, data we retrieve on your behalf from connected systems, and the project workspace contents and outputs generated by the agent for you. You retain all ownership rights to Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process Your Content solely to operate, maintain, secure, and improve the Service for you.

5. Acceptable Use

You agree not to:

  • use the Service to violate any law, infringe any third party's rights, or breach a contract you are bound by;
  • attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or to other users' data;
  • use the Service to send spam, malware, or unsolicited communications; or
  • use the Service to act on systems or properties you are not authorized to control.

6. Agent Output and Human Review

The Service produces automated output (code changes, content drafts, recommendations, and experiments). Automated output may be incorrect or unsuitable. You are responsible for reviewing output before it is published, merged, or otherwise applied to production systems. We make no warranty that automated changes will achieve any particular business outcome.

7. Beta Features

Parts of the Service may be marked “beta,” “preview,” or similar. These features are provided “as is,” may be changed or removed at any time, and are excluded from any service-level commitments.

8. Fees

If you subscribe to a paid plan, you agree to pay the applicable fees. Fees are billed in advance and are non-refundable except where required by law. We may change pricing on prospective renewals with reasonable notice.

9. Termination

You may stop using the Service at any time and may request deletion of your account by emailing hello@emotionmachine.ai. We may suspend or terminate your access if you breach these Terms or if continued operation would expose us or other users to legal or security risk. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will survive.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AUTOMATED OUTPUT WILL BE ACCURATE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS.

12. Indemnification

You will defend, indemnify, and hold us harmless from third-party claims arising out of (a) Your Content, (b) your use of the Service in violation of these Terms, or (c) actions the Service takes on connected systems pursuant to authorizations you granted.

13. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated by email or in-app notice and take effect on the date stated. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and each party consents to personal jurisdiction there.
